PREAMBLE:
These general terms and conditions of sale (GTC) have been drafted in full compliance with the Consumer Code.
REMINDER OF THE LEGISLATION:
It is the buyer's responsibility to track their package online using the tracking link provided and to make every effort to retrieve their package and immediately report any anomaly observed to the CARRIER.
Any package returned to the seller, even if the tracking link has been provided to the buyer, will be considered a cancellation (except in cases of warranty).
I - DELIVERY OF PACKAGES:
I-1: Delivery Method:
All orders are shipped via tracked parcel: A tracking link is sent by email to the buyer as soon as the product is shipped. As a reminder, it is the buyer's responsibility to track their package online using the provided tracking link and to take all necessary steps to retrieve it and immediately report any issues to the carrier. In case of a dispute, the buyer can request proof of delivery from the seller. This proof (provided by the carrier) serves to demonstrate the seller's good faith and the shipment of the package to the address provided by the buyer. This document can be signed by the carrier or a third party, as tracked packages are not considered signature-required.
I-2 Delivery to a Pickup Point:
The law authorizes all carriers to leave packages at post offices or pickup points for any reason to prevent theft or loss. This information will be displayed on your package tracking by clicking on "identify pickup point." The pickup point will be displayed until the package is handed over to the buyer (marked as delivered) or for the legally mandated holding period, which is a maximum of 7-10 days. After this period, the relay point address will no longer be visible and the package will be returned to the sender at the buyer's expense. These costs will then be deducted from any potential refund. By placing an order, the buyer unconditionally accepts this condition.
I-3 Uncollected Product:
In accordance with the law, any item ordered but not collected by the buyer (despite the tracking link provided) or which cannot be delivered by the carrier due to an incorrect or incomplete address, absence, or any other reason, WILL BE RETURNED TO THE SELLER after 7 days at the buyer's expense (HAMON LAW).
I-4 Delivery Delays:
The displayed delivery times are the usual times announced by the carriers. They are not contractual but cannot exceed 30 days. We cannot be held responsible for delays caused by the carriers, especially during peak periods such as Christmas, Valentine's Day, etc. or during periods of strikes or inclement weather. Any claim following a late delivery will be refused.
I-5 Order marked as delivered but not received:
If the tracking information indicates "delivered" but you have not received your package, you have 48 hours to notify the seller of the non-receipt. The seller will then request an investigation from the carrier.
IMPORTANT NOTES:
- The seller cannot be held responsible if the buyer has not tracked their package.
- The seller cannot be held responsible if the buyer does not respond to any delivery issues mentioned in the tracking information.
- The seller cannot be held responsible if the buyer does not contact the seller within 48 hours if the tracking information indicates that the package has been delivered but the buyer claims not to have received it.
I-6 Refused package:
Any refused package is considered a cancellation. The return of the package will then be at the buyer's risk. Return shipping costs will then be borne by the buyer (Hamon Law).
I-7 Order Cancellation - Change of Address:
An order is considered firm and final from the moment the buyer clicks the "order" button and payment is accepted. Order processing is carried out electronically, and this procedure cannot be stopped. Cancellation or a change of address is then no longer possible.
II. RIGHT OF WITHDRAWAL (Hamon Law)
II-1 Conditions for withdrawal:
The buyer has 14 days from the date of delivery or presentation of the package at the address indicated by the buyer to exercise their right of withdrawal, provided that the product is returned in such a way that it can be resold "as is," that is to say, new, unused, complete, if possible in its original packaging, and placed in an outer box (for example, the one provided with the shipment).
IMPORTANT NOTES:
Any package refused or not collected by the buyer is considered a withdrawal. It is the customer's responsibility to track their package using the tracking link provided. If the tracking indicates that the carrier has attempted delivery, the buyer is considered to have been "notified" of the carrier's attempt. A paper delivery notice is not mandatory. Return shipping costs are always the responsibility of the buyer. (HAMON LAW). The refund will be processed within a maximum of 14 days after the seller receives and inspects the package. If the product shows signs of use, is returned incomplete, or if any incident prevents the product from being resold in its current condition, we reserve the right to charge for repairs or refuse the refund. In the latter case, the product will be reshipped to the buyer at their expense. If the buyer refuses the refund, the product will be destroyed within 30 days without any compensation to the buyer. As the return is the buyer's responsibility, no refund will be issued if the product arrives damaged.
III. WARRANTY & NON-CONFORMITY:
As the products originate from abroad, the seller is unable to arrange return shipping or collect products from a pickup point.
III.1 Non-Conformity
Any product received that does not match the description of the product ordered is considered non-conforming. (https://www.service-public.fr/particuliers/vosdroits/F11094):
A lack of conformity is considered to exist in the following situations:
- The goods are unfit for the purpose for which similar goods are normally used (for example, a product normally designed to operate wirelessly on battery power must be plugged into the mains, repeated malfunctions, missing features, etc.).
- The goods do not correspond to the description given by the seller, even if they function perfectly. For example, the color does not match the model shown.
- The goods do not possess the qualities advertised by the seller or agreed upon with you (for example, a cooker hood, presented as particularly quiet, turns out to be noisy).
IMPORTANT NOTES:
A product received damaged during transport is not considered a lack of conformity! (Articles L216-4, L216-5 and L. 224-65 of the French Consumer Code)
III-2 Product received broken
The seller is responsible for the proper performance of the contract. However, if a product arrives damaged in transit, it is essential to determine the cause of the damage: damage due to shipping or damage that occurred after the package was received (dropped during unpacking, etc.). The Consumer Code specifies that:
In accordance with Article L216-4 of the Consumer Code, all risk of loss or damage to goods is transferred to the consumer when they, or a third party designated by them (other than the carrier proposed by the seller), take physical possession of the goods.
The buyer has 72 hours from receipt of the package to report the damage to the carrier by registered letter with acknowledgment of receipt. This 72-hour period is extended to a maximum of 10 days if the package was not delivered directly to the buyer.
After this period, the carrier can no longer be held liable, and the damage is considered "an accident due to the buyer's negligence." In this case, the warranty does not apply, and the seller is no longer liable.
III-3 24-Month Warranty on All Products
The product must be returned CLEAN with all accessories and instructions, and if possible, in its original packaging. The product must be returned in outer packaging (for example, the packaging used for shipping).
Important:
If the product is found to be in perfect working order, it will be returned to the buyer at their expense. If the buyer refuses the return shipment, the product will be destroyed within 30 days without any compensation to the buyer. If the product has a manufacturing defect, the return shipping costs will be refunded.
Warranty Application:
The amount of the return shipping refund cannot exceed the amount charged by the seller for the initial shipment (maximum amount = outbound shipping costs). Refunds are processed within a maximum of 14 days after the seller receives and inspects the package.
IMPORTANT NOTES:
The warranty does not cover:
- Damage caused by a third party or resulting from intentional or fraudulent misconduct.
- Damage resulting from the use of energy, operation, or installation not in accordance with the manufacturer's instructions, or from negligence.
- Replacement of accessories (such as filters, vacuum cleaner brushes and hoses), replacement of batteries, bulbs, tubes, and lamps for overhead and video projectors, and any presentation parts that do not impede the proper functioning of the device.
- Damage resulting from oxidation (e.g., mobile phones, camcorders, digital cameras, etc.).
- Antenna malfunctions, incorrect connections, or improper setup.
- Damage resulting from commercial, industrial, craft, or professional use.
- Damage resulting from external causes such as impact, drops, lightning, fire, water damage, storms, or vandalism.
- Batteries and accumulators included in the products (watches, mobile phones, etc.)
